This Privacy and Personal Data Processing Policy (the "Policy") explains how BORNEO CLOTHING S.A.S. collects, uses, stores, shares and protects your personal data, in compliance with Colombian Law 1581 of 2012, Decree 1377 of 2013 (compiled in Decree 1074 of 2015) and other Colombian personal data protection rules.

2. Data we collect
- Identification and contact data: name, ID number where required for invoicing or shipping, email address, phone number.
- Delivery and billing data: address, city, country and postal code.
- Transaction data: products purchased, amounts, payment method used, order history, returns and exchanges. Your full card details are processed directly by payment gateways and are not stored by BORNEO.
- Account data: username, preferences and settings, if you create an account.
- Browsing and device data: IP address, browser and device type, pages visited, and products viewed or added to cart, collected through cookies and similar technologies.
- Communications: information you give us when you write to us, file a claim or post a review.
We do not request sensitive data. If it were ever required, providing it would be optional and we would tell you so expressly.
3. Purposes of processing
We process your data to:
- Process, invoice, ship and deliver your orders, and manage payments, exchanges, returns, warranty claims and payment reversals.
- Create and manage your customer account.
- Handle your requests, complaints and claims, and contact you about your orders.
- Prevent fraud and protect the security of the Site, our customers and BORNEO.
- Send you marketing communications, promotions, news and surveys by email, text message, WhatsApp or other channels, where you have authorized us to do so. You may withdraw this authorization at any time.
- Show you personalized advertising on the Site and on third-party platforms, and measure the performance of our campaigns.
- Analyze use of the Site to improve our products, services and shopping experience.
- Comply with legal, accounting and tax obligations and with requests from competent authorities.
- Exercise and defend BORNEO's rights in administrative or judicial proceedings.
4. Authorization
We process your data with your prior, express and informed authorization, which you may give in writing, orally or through unequivocal conduct, such as registering on the Site, making a purchase, subscribing to our newsletter or contacting us through our customer service channels. Authorization is not required in the cases exempted by Article 10 of Law 1581 of 2012.
5. Minors
Our products and the Site are intended for adults. We do not knowingly collect data from minors. If you become aware that a minor has provided us with personal data, please contact us so that we can delete it.
6. Who we share your data with
To the extent necessary for the purposes described above, we may transmit or transfer your data to:
- Shopify, the platform on which our store runs.
- Payment gateways and financial institutions that process your payments, and financing providers such as ADDI when you choose that option.
- Shipping and courier companies that deliver your orders.
- Providers of technology, hosting, email, customer service, reviews, analytics and advertising services (for example, Google and Meta).
- Competent authorities, when required by law.
Some of these providers are located outside Colombia, so your data may be transmitted or transferred to other countries, including the United States, Canada and countries of the European Union. By accepting this Policy you authorize these international transfers and transmissions. We require our providers to apply appropriate security and confidentiality measures. BORNEO does not sell your personal data.
7. Your rights as a data subject
Under Article 8 of Law 1581 of 2012, you have the right to:
- Know, update and correct your personal data.
- Request proof of the authorization you granted.
- Be informed about how your data has been used.
- File complaints with the Superintendence of Industry and Commerce (SIC) after completing the inquiry or claim process with BORNEO.
- Revoke your authorization and request deletion of your data, where there is no legal or contractual duty to keep it.
- Access your personal data free of charge.
8. How to exercise your rights
BORNEO's Customer Service department is responsible for handling personal data inquiries and claims, at contact@borneomen.com or at the address listed in section 1. Your request must include your name, contact details, a description of what you are requesting and, if you are acting on behalf of someone else, a document proving your authority.
- Inquiries: answered within ten (10) business days of receipt. If this is not possible, we will explain why and give you a response date no later than five (5) additional business days.
- Claims (correction, update, deletion or non-compliance): answered within fifteen (15) business days of receipt, extendable by up to eight (8) additional business days with prior notice. If a claim is incomplete, we will ask you to complete it within five (5) days; if two (2) months pass without you doing so, the claim will be deemed withdrawn.
9. Cookies and similar technologies
We use our own and third-party cookies to operate the store (for example, the shopping cart), remember your preferences, and for analytics and advertising. You can set your browser to block or delete cookies and manage your preferences in the Site's cookie banner. If you block necessary cookies, some features of the Site may not work properly.
10. Security and retention
We apply reasonable technical, human and administrative measures to protect your data against loss, unauthorized access, misuse or alteration. No system is completely infallible, so we recommend that you do not share your login credentials. We keep your data for as long as necessary to fulfill the purposes described and for the periods required by accounting, tax and commercial regulations.
11. Visitors from other countries
If you live outside Colombia, the laws of your country may grant you additional rights, such as the right to opt out of the use of your data for targeted advertising. You can exercise them by emailing contact@borneomen.com or, if you live in the United States, through the Your Privacy Choices page. We honor your browser's Global Privacy Control signal where required by law. Shopify processes certain information as an independent controller; you can read its Consumer Privacy Policy.
12. Changes to this Policy
We may amend this Policy. Material changes will be communicated through the Site or by email before they take effect. The current version will always be published on this page.
13. Effective date
This Policy is effective as of September 11, 2026. Databases will remain in force for as long as the purposes of processing and legal retention obligations subsist.
In the event of any discrepancy between this English version and the Spanish version, the Spanish version shall prevail.
