1. Seller information

The website borneomen.com (the "Site") and the online store operating on it are run by BORNEO CLOTHING S.A.S. ("BORNEO", "we", "us"), a Colombian company domiciled in Medellín, Antioquia.

2. Acceptance of these Terms

These Terms of Service (the "Terms") govern access to and use of the Site and the purchase of products through it. By browsing the Site or placing an order, you confirm that you have read, understood and accepted these Terms, as well as our Privacy Policy, Shipping Policy and Returns Policy, which form an integral part of these Terms. If you do not agree, please do not use the Site.

Contracts entered into through the Site are valid and legally binding under Colombian Law 527 of 1999 on electronic commerce.

3. Legal capacity

To purchase on the Site you must be of legal age and have the legal capacity to enter into contracts. By placing an order you confirm that the information you provide is true, complete and up to date, and that you are authorized to use the selected payment method.

4. Products and information

We strive to ensure that product descriptions, photos, measurements and size guides are accurate. Colors may vary slightly depending on your device's screen settings, and garments may show small differences inherent to their manufacturing. Product availability is subject to stock at the time of purchase.

5. Prices, currency and payment methods

  • Prices are expressed and charged in Colombian pesos (COP) and include applicable Colombian taxes. Shipping costs are shown at checkout before payment.
  • The Site may display prices converted into other currencies as a reference for visitors from other countries. These amounts are approximate and for information only: payment is charged in COP, and the final amount in your currency will depend on the exchange rate and fees applied by your bank or card issuer.
  • For international purchases, taxes, duties and import charges in the destination country are not included unless checkout states otherwise.
  • Payments are processed through third-party payment gateways. BORNEO does not store your full card details.
  • Financing options, such as ADDI, are provided by third parties under their own terms and conditions, and credit approval depends solely on them.

6. Ordering and confirmation

The sales contract is formed when you receive the order confirmation email and payment is verified. Before paying, you can review your order summary, including products, quantities, total price, shipping costs and payment method. Keep the confirmation email as proof of purchase.

BORNEO may decline to process or may cancel an order when there are reasonable indications of fraud, identity theft or unauthorized use of the payment method, or when the product is unavailable. In such cases we will notify you and refund the full amount paid.

If there is an obvious and unmistakable error in a product's published price (for example, a typing error that makes it clearly disproportionate), we will notify you before dispatch and you may choose either to continue with the purchase at the correct price or to cancel it and receive a full refund.

7. Shipping

Delivery timeframes, costs and conditions are governed by our Shipping Policy. Delivery times are estimates.

8. Right of withdrawal

Under Article 47 of Colombian Law 1480 of 2011 (Consumer Statute), for purchases made through the Site you may exercise the right of withdrawal within five (5) business days after delivery of the product, subject to the following conditions:

  • You must notify us of your decision at contact@borneomen.com, stating your order number.
  • The product must be returned in the same condition in which you received it: unworn, unwashed, with its original tags and packaging.
  • Transport costs and any other costs of returning the product are borne by you.
  • We will refund the full amount paid, without deductions or withholdings, within thirty (30) calendar days after you exercise the right.

Under the same law, the right of withdrawal does not apply, among other cases, to goods for personal use. For hygiene and health reasons, goods for personal use include underwear (briefs, jockinis, jockstraps and similar items) and swimwear whose hygienic liner has been removed, as well as products made or customized to the customer's specifications.

9. Voluntary exchanges and returns

In addition to the right of withdrawal, BORNEO offers voluntary exchanges and returns under its Returns Policy. That policy is a commercial courtesy and does not limit or replace the rights granted to you by law.

10. Legal warranty

Our products are covered by the legal warranty provided for in Law 1480 of 2011, which covers the quality, suitability, safety and good condition and operation of the products. The warranty period is three (3) months from delivery, unless a mandatory rule sets a different period.

To make a warranty claim, email us at contact@borneomen.com with your order number, a description of the defect and photos. We will inspect the product and, if the defect is covered, we will repair it, replace it or refund your money, as provided by law.

Under Article 16 of Law 1480 of 2011, the warranty does not cover damage caused by force majeure or unforeseeable circumstances, acts of third parties, improper use of the product, or failure to follow the use, washing and care instructions on the label or on the Site. Nor does it cover natural wear and tear from use, or deterioration caused by contact with chlorine, tanning products, creams or other chemicals when the care instructions warn against it.

11. Payment reversal

If you paid by credit card, debit card or any other electronic payment instrument, you may request a payment reversal in the cases provided for in Article 51 of Law 1480 of 2011 (fraud, unsolicited transaction, product not received, or product that does not match what was ordered or is defective). To do so, you must file a complaint with BORNEO and notify the issuer of the payment instrument within five (5) business days after becoming aware of the transaction, and return the product where applicable. Reversal does not apply when the stated reason does not correspond to the facts.

12. Requests, complaints and claims

You may submit requests, complaints and claims to contact@borneomen.com or via WhatsApp at +57 304 367 7628. We will respond within fifteen (15) business days of receipt.

13. Intellectual property

The BORNEO brand, its logos, designs, prints, photographs, texts and other content on the Site are owned by BORNEO CLOTHING S.A.S. or its licensors and are protected by Colombian and international intellectual property laws. Their reproduction, distribution, modification or commercial use without BORNEO's prior written authorization is prohibited. Purchasing a product does not grant any rights over the brand or its designs.

14. Use of the Site

You agree to use the Site lawfully and not to: make purchases for unauthorized resale; provide false information; impersonate others; interfere with the security or operation of the Site; introduce malicious code; or extract content by automated means. BORNEO may suspend or cancel the access and orders of anyone who breaches these Terms.

15. Reviews and user content

If you post reviews, photos or comments about our products, you confirm that they are truthful and that you have the right to share them, and you grant BORNEO a free, non-exclusive authorization to use, reproduce and publish them on the Site, on social media and in its marketing communications. BORNEO may remove content that is unlawful, offensive, false or infringes third-party rights.

16. Third-party services and links

The store runs on the Shopify platform and uses third-party services such as payment gateways, carriers, financing options and apps. The Site may also include links to third-party websites. These services are governed by their own terms and policies, and BORNEO is not responsible for their content or operation, without prejudice to the obligations the law imposes on it as a seller.

17. Liability

To the fullest extent permitted by law, BORNEO shall not be liable for indirect damages or for temporary unavailability of the Site due to technical reasons, maintenance or events beyond its control. Nothing in these Terms limits or excludes the non-waivable rights and guarantees granted to consumers by law, or any liability that cannot legally be limited.

18. Personal data protection

The processing of your personal data is governed by our Privacy and Personal Data Processing Policy, in accordance with Colombian Law 1581 of 2012 and its regulations.

19. Changes

BORNEO may amend these Terms at any time. Changes take effect upon publication on the Site and do not affect orders confirmed before publication, which will be governed by the Terms in force at the time of purchase.

20. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Before bringing any legal action, we invite you to contact us to seek a direct solution. Any dispute that cannot be resolved in that way shall be submitted to the competent courts of the city of Medellín, Antioquia, Colombia, without prejudice to the consumer's right to file consumer protection actions before the Superintendence of Industry and Commerce (SIC) and to any other mandatory jurisdiction rules established by law in the consumer's favor.

If you purchase from another country, you acknowledge that the sale is deemed to have been concluded in Colombia, without prejudice to any mandatory consumer protection rules that may apply to you.

21. Severability

If any provision of these Terms is declared void or unenforceable, the remaining provisions shall remain in full force and effect.
